Question for my fellow perverted fan fiction writers

Recommended Posts

Not that this will ever happen, but just for fun:

If someone associated with a character you write about (the actor who plays him or her, the creator of the character, the producer of the show the character comes from, etc) ever contacted you asking that you stop sharing your perverted fan fiction about that character, would you stop?

Someone asked me that once, and I still don't know how I would answer.  I think it would depend on the character they wanted to me stop writing about, and their reasons for wanting me to stop.

Yes, but only if they both were involved in the creation of the character (so that they had some right to Ask such a thing.) And had a solid reason. For example, I doubt Miyamoto's tweet about Mario And Luigi kissing would stop anyone from making such art, since there isn't any solid reason for it, but when Toby Fox asked people to tone down the under tail, he was doing so because when people searched for his game, the porn was coming up first.

Not quite sure I understand completely; but if you wrote a work of fiction with the usual disclaimer, your work is protected. See: Peyton Place, and the legal wrangling that went on. Author used alive people, told the unvarnished truth and was allowed to publish.

Perhaps Fanfic (fanfiction ?) uses different rules of publication. That I don't know - I just write good old smut.

^IP law is fucked up and courts tend to rule in favor of whoever has more money rather than who is in the right. In an ideal world, all derivative works, fanworks included, would be protected provided they weren't guilty of plagiarism and kept source materiel use within that allowed by fair use. No idea how closely IP law matches the ideal, but in practice, it depends on how much of an asshole the IP holder wants to be and most fans don't have the resources to fight even a bogus claim of infringement if the IP Holder decides to take it to court. I also think it worth noting that, thanks to bullshit like the doctrine of work for hire(which makes it legal for employers to steal their employee's IP) and the fact that publishers are often in a strong enough position to demand ownership of what they publish, the IP Holder often isn't the creator.

And that isn't even the tip of the iceberg when it comes to how IP law works against its stated goal of promoting creativity.

I agree with the above statement, but with a stronger dose of trust in government and law.

If I wrote some sexy fanfiction about whatever (I'd probably choose Dar-Ma from the Elder Scrolls: Oblivion as the character*) and was asked to remove it, then I would indeed enquire as to the logical reason for such dismantling before agreeing.

On top of this, being motivated to keep the fanfiction, I would attempt to psychologically manipu- er, 'gently persuade' them how much of a profitable promotion this is and other tactically advantageous reasons NOT to destroy my precious work**.

*WHAT? It's the classic innocent damsel in distress romance. She even adores you and affectionately says "my hero" after you rescue her from a cult!
**Why go to war with them when you can flatter the crap out of them and just have them agree with you?

Although I don't write much (simultaneous motivation and time off work is hard to come by...), and I've only published one completed fic to-date, I figured I'd give my $0.02 ;)

Aaaand then I read Choc's comment and decided to piggy back off it! Basically, the only time I'd choose to take down content is if I was substantially hurting the original creator, or the original work itself, and the creator themselves asked me too, with that specifically as the reason.

If I liked a character/fandom enough that I bothered to write fanfiction of it, the last thing I'd want to do is hurt the community around it, or the person to thank for it in the first place :)

Edit: In all seriousness though, I wouldn't worry about ever even getting such a request. This kind of material is completely ignored by content creators and celebrities 99% of the time. The benefit they'd get from potential customers/users/fans not seeing R34 of them and/or their work is completely wasted if Kotaku or TMZ does a story on the lawsuit/DMCA, giving it way more exposure than it would've ever garnered alone.
